Terms of Use and Privacy Policy
This website is owned and operated by Ch Bilisim Teknolojileri Ltd. (UK Company No. 15635479) and will be referred to as “We”, “our” and “us” within this Terms & Conditions document. By using this website (“the website”), you agree to the Terms & Conditions set out on this website page. These Terms & Conditions relate to our responsibilities and the responsibilities of yourself in all conduct relating to this website and the services it provides.
Definitions
Company – The website and services provided by Oprica Ltd.
Service(s) – The immediate hosted service(s) provided by the company for rental.
Customer – A person or group purchasing or intending to purchase services with the website.
Control panel – The private potal provided by the company where customers may manage their account.
Responsibility Guidelines
Company Responsibilities
We are responsible for the maintenance and uptime of our computer hardware, immediate network and services with the intention of performing all maintenance during off-peak periods. We will strive to provide the customer with low ping times based upon their geographic location, however network disruptions outside of our immediate network are out of our control and we accept no responsibility for these. We will provide a control panel for the use of the customer, to control their services at all times.
Customer Responsibilities
The customer is responsible for providing the company with true and current information in regards to registration and financial or payment details. This extends to updating these details if there is a change. The customer is responsible for the upkeep of their own service, including but not limited to:
- Managing user access.
- Managing stored files and ensuring no illegal content is uploaded to the company’s servers.
- Managing all service configurations.
- Backup of all information relating to customer services.
The company will not be responsible for the loss of any information uploaded to our servers.
In addition, customers may not rent, lease or sublet any service to any other individual or group during their service term. Customers must ensure that their service abides by our Terms & Conditions at all times.
Payments & Subscriptions
When purchasing any service with the company, the customer chooses whether billing is on an auto-renewing basis or a one-off basis. If the customer chooses an auto-renewing basis they also choose a billing cycle of 1, 3 or 6 months. Customers who choose to be billed on an auto-renewing basis agree to be bound to a recurring subscription of that service which will be charged at each billing cycle. Service subscriptions shall recur until cancellation has been requested by the customer, or the auto-renew option has been disabled by the customer via the control panel.
For services on an auto-renewing basis, the company will attempt to charge the customer 3 days before the start of the next billing cycle so as to prevent service interruption. In the event of a failed renewal, the company will notify the customer via email and then attempt to charge the customer every day thereafter until the service expiry date. Auto-renewing services which have failed to renew by the end of the service term will be automatically suspended and the customer will be notified via email. Suspended services may be manually reactivated by the customer via the control panel. Suspended services are subject to deletion after a 7 day period, and the company shall not be held responsible for loss of customer data should this occur.
Refund Policy
New customers who are not satisfied with services purchased for any reason, may request a full refund during the first 7 days of service from the service start date by contacting the Company. The start date for this purpose shall be the date and time of ordered service creation.
Failure to Comply
Failure to comply with all current and future Terms & Conditions agreements may result in termination of the customer account and/or service interruption without refund. We reserve the right to suspend any service if we find that it is in violation of our Terms & Conditions, until the account holder ensures that his/her service complies. Subscription periods will not be affected by downtime caused by account suspension.
Ratification of the Agreement:
To become a member of Climbhost.com, you must first complete our registration form and agree and undertake to abide by the terms of the Climbhost.com membership agreement. The user is deemed to have undertaken to comply with the Climbhost.com agreement from the moment he/she completes and approves the registration form or receives any service or order using this system.
Description of Services:
Climbhost.com offers its members who approve the contract the opportunity to use TeamSpeak 3, Game Server or VDS/VPS server from the internet environment.
Climbhost.com Membership System:
Climbhost.com member will have a ‘username’ and ‘password’ to be determined by the user. The ‘username’ is unique to the member and the same ‘username’ will not be given to two different members. The ‘password’ is known only by the user. The user can change the password at any time. The choice and protection of the password is the sole responsibility of the user. Climbhost.com is not responsible for any problems arising from the use of the password. Climbhost.com informs the user via e-mail only about the promotions that are in his/her region and that he/she can benefit from. Climbhost.com will never share user information with third party companies or send e-mails on behalf of third party companies. In order for the user to connect to services that require Climbhost.com membership, the user must enter his user name and password. This process is defined as ‘logging in’ to Climbhost.com.
Responsibilities
Climbhost will provide the services specified in the order at the request of the buyer. With the payment confirmation message, Climbhost acknowledges that it has collected the relevant fee and undertakes to provide the service specified in the order in question.
After order acceptance and confirmation of transactions, climbhost will send the control panel ftp, sql and e-mail usernames and passwords to the buyer for the service in the buyer order detail and the service will be started.
The responsibility of the relevant accounts and passwords is the responsibility of the renter and the buyer will be responsible for any damage and loss that may arise from these issues.
The buyer undertakes to comply with the statements and warnings received by climbhost within the service received by the buyer, the buyer agrees and undertakes to comply with any warnings or notices published by climbhost while benefiting from the server service. The buyer cannot transfer the services provided to him free of charge and unlimited in the possession service he has received to third parties without the written approval of climbhost for paid or free and / or limited or unlimited.
While Member is using Climbhost.com services,
That the information contained in the registration form is correct and that in cases where this information is required, it is responsible for any damages arising from incorrect or incomplete information (such as forgetting the password) and that its membership may be terminated in these cases,
Persons renting Teamspeak 3 services are deemed to have accepted Climbhost.com’s right to rearrange the monthly fees and rental periods of the existing services if deemed necessary within the scope of TeamSpeak’s license policy.
Persons who pay Climbhost.com for the campaigns created by Climbhost.com cannot benefit from the same campaign for the second time before the end of the rental period including the campaign period, in order to benefit from the campaigns that are continuous, the person must complete the rental period including the campaign or have a maximum of 15 days left.
That the copyright of the services and software provided by Climbhost.com belongs to Climbhost.com and that you will not reproduce or distribute this software in any way,
That the personal ideas, thoughts, expressions, files added to the Climbhost.com environment, personal information sent by Climbhost.com when using Climbhost.com services are the responsibility of Climbhost.com and Climbhost.com cannot be held responsible for these files in any way,
In some cases, the services provided by Climbhost.com may contain information belonging to persons over the age of 18, for which Climbhost.com shall not be responsible,
The person is responsible for the configuration and adjustment of the rented server and climbhost.com is not obliged to make such adjustments,
Climbhost.com will not be responsible for information, messages and files that will be lost and/or incomplete during the use of its services, or that will be transmitted to the wrong address,
Not to access the services offered on Climbhost.com in any unauthorized manner other than in the manner specified by Climbhost.com and not to modify the software in any way, not to use the software that is obviously modified, and to pay all material and moral damages that Climbhost.com may incur in case of non-compliance with the aforementioned articles,
Climbhost.com will not be responsible for any damages that may arise from the modification and deletion of the data and data in the rented server by other persons and persons on the server,
Not to send messages that are threatening, immoral, insulting, racist, contrary to the laws of the relevant country, international agreements,
Correspondence, subject headings, nicknames to be added to the environment must comply with the general rules of morality, etiquette and law,

Not to use Climbhost.com services for commercial or advertising purposes without permission from Climbhost.com,
That Climbhost.com may monitor the entire system at any time or on an ongoing basis,
Climbhost.com reserves the right to cancel the service by informing the user in transactions that Climbhost.com finds suspicious, and persons and persons who purchase services are deemed to have undertaken to avoid suspicious transactions.
In case of violation of the rules, Climbhost.com has the right to take necessary interventions and remove the member from the service and terminate the customer’s membership without refund,
Climbhost.com may use its system for commercial purposes,

Authorizations Granted to Climbhost.com:
Climbhost.com may temporarily suspend or completely stop the operation of the system at any time.
Climbhost.com shall have no liability to its members or third parties for any temporary suspension or complete cessation of the system.
The username and password will be displayed and confirmed by Climbhost.com after filling in the application fields provided to the customer.
Climbhost.com may indefinitely prevent customers who have filled in all fields, or customers who have a password but are connecting, from having a new password or using their password, as it deems appropriate.
Climbhost.com does not guarantee that its services will be provided in a timely, secure and error-free manner, that the results obtained from the use of the service are accurate and reliable, and that the quality of service will meet expectations.
Climbhost.com will not be held responsible for any data loss arising from incorrect adjustments made by the customer on the server.
Climbhost.com has the authority to backup and delete some or all of the files, messages and messages that members will keep in the environment during the use of the services. Climbhost.com will not be held responsible for backup and deletion.
Climbhost.com reserves the right to change and update the server, data center or IP address to which the service provided to the customer is connected by providing a specific justification.
Climbhost.com makes rdns arrangement to the VDS / VPS server ip addresses that it rents only to VDS partners.
Climbhost.com does not have any responsibility for the ip address of the VDS / VPS server that it has rented due to the TeamSpeak 3 blacklist entry or entry.
Climbhost.com uses a heuristic firewall system to keep the UDP port range specified by the customer during the VDS/VPS server order alive, during an attack that may affect the specified UDP ports, the attack protocols made to keep these ports alive are automatically or manually blocked on the firewall.
Climbhost.com will instantly stop the server service of people who make DDoS attacks etc. through the VDS / VPS servers they have rented.
Climbhost.com does not share Query port information on its servers.
Climbhost.com reserves the right to update and make changes to the web panel it offers.
Climbhost.com tries to keep its servers at an average ping value of 10-150 ms and never guarantees low ping (ms).
Climbhost.com will keep the servers whose rental period has expired and closed for 2 more days. If payment is not made again for the server that is closed within 2 days, it has the right to delete the server completely.
Climbhost.com’s sales are limited to the current availability of its service. Climbhost.com may not deliver products that are not included in the relevant product/service list. By displaying the products/services on the website, Climbhost.com does not guarantee that the products/services are in stock.
Information, documents, software, designs, graphics, etc. produced by Climbhost.com members and uploaded to the system of their own free will to be published (e.g. messages, notes, files added to the board). has the right to publish the works and/or move them to another address deemed appropriate by Climbhost.com within the site. It is possible that this published information may be copied and/or published by other users. In these cases, the member will not request any royalties from Climbhost.com.
Climbhost.com is responsible for changing the price and product feature information of the products/services offered for sale on Climbhost.com. If an error occurs in the price and product/service feature information, Climbhost.com may deliver the product/service or cancel the order to correct this error.
Climbhost.com can enable the member to move to other websites. In this case, the member accepts that Climbhost.com is not responsible for the content of the sites to which he/she will navigate.
Climbhost.com may make changes in the implementation of this agreement, as well as change existing articles or add new articles, in order to comply with future technical requirements and legislation.
Climbhost.com services that do not require membership may be converted to membership-requiring services over time. Climbhost.com may open additional services, change some of its services partially or completely, or turn them into paid services.
Personal and Non-Commercial Use Limitation:
Users agree that all purchases made are for personal use and not for resale or commercial purposes.
